'Tis the Season to Pay Your Debts!

To all who read this: I have tried over the past two years to collect money that is owed to me. Lawyers have been involved in a number of these cases and served to only make matters worse by dragging out the inevitable. I will not lie or slander anyone in these letters. My intent is not to intimidate or threaten, only to tell the truth, the whole truth and nothing but the truth as I see it. All those I'm writing about are more than welcome to write their side of the truth. I'm tired of dealing with unscrupulous lawyers. All the money that was mine, when paid will be donated to Orphanage Quest. It's time to make wrongs right, period.

Dear Susette,


I’m writing to you as all attempts to deal with your husband in regards to this issue have been handled in a manner that shows he has no integrity at all.


I met your husband, Jamael through Robb Hartland, my morning D.J. at CKTP Radio. As you are aware, Jamael did numerous shows on my station in regards to automobiles. I still personally feel it was one of the best shows we put on during my time with the station!


There were numerous people who questioned my affiliation with Jamael as they didn’t like him for one reason or the other. Most said he couldn’t be trusted but personally I felt they didn’t like him because of his race.


At the time this mattered little to me as Jamael was helping me by giving me a two-hour Automotive Show and I was giving him free advertising for his Auto Works business. It was his partner on the show of York Motors that I trusted as Andy was well-known and respected in Fredericton.


During the fall of 2005, Jamael came into possession of my favourite vehicle, a 1995 Jaguar. Of course, being the salesman he was, he was unrelenting during the rest of 2005 and on into early 2006.


In February, 2006, my life was turned upside down when I was forced against my will into the psychiatric department of the Dr. Everett Chalmers Hospital. When I got out after a three-day stay, I was mad at the world. I felt betrayed by family, business partners and Police. In this moment of self pity, I made the comment to Jamael that for my upcoming 50th Birthday, I should buy myself the Jaguar and of course, he pounced on the idea, as would any good used car salesman.


Being a man of great self-control, I resisted this urge to indulge myself and resisted the persistent phone calls and visits from Jamael.


Then in March of 2006, just a week prior to my 50th Birthday, I was arrested on a Form 11 by a complete SWAT Team and again, taken to the Dr. Everett Chalmers Hospital. The form 11 made it so I could not leave the hospital for 30 days or until a psychiatrist deemed me mentally competent. I was held down and injected with a drug that knocked me out for two full days.


When I awoke, my first visitor was Jamael. I was livid at my situation and thinking my wife and children had put me in this situation, decided to show them I could do what I wanted. First, however, I discussed with Jamael that my business partners and other friends told me not to trust him. His response to this was to show me a picture of his beautiful daughters and you. He said, “My wife is a respected Orthodontist. We have a half million dollar home in Fredericton’s most prestigious subdivision. He went on to remind me of the visit he took me on of your beautiful home and suggested those who spoke badly of him were just jealous. I could relate to this and a deal was struck for the purchase of the Jaguar right there on 2 S.E. of the hospital. A crazy deal made in a crazy house.


The next day, Jamael returned to get a check from me for $18,500. While there, he found out that a tribunal was going to sit and discuss why I should be kept here for observation. Jamael stayed and sat in on this tribunal and is on record as the only person to speak positively on my behalf. The rest who spoke were concerned I was taking cocaine, working too hard, etc.


Jamael left with my check on March 14th and we had a deal that the Jaguar would be delivered on March 18th to a space in the parking lot that could be seen from my hospital window.


That same day, I got a call from Jamael as he was at my bank and they were concerned about the amount of the check. He passed his phone to the bank manager and I informed the bank manager to release the money to him. The car was delivered as promised on the 18th of March.


On the 21st of March, after only 8 days, I was released from the hospital with a prescription for sleeping pills to help me slow down some. The doctor felt that the source of my anxiety was the Police and political interference in my business over the previous eight to ten weeks. He was concerned about how a Form 11 could get issued on a man of 50 years old with no medical or criminal history. He gave me a copy of the Medical Act and told me my rights were being violated. This psychiatrist had never in his career been able to get a Form 11, even for people with lengthy mental and criminal histories!


Susan, you may not feel you have a role to play in any of this, but I assure you, had Jamael been a single man at the time of making my decision to buy the Jaguar, I wouldn’t have bought it. It was you and your beautiful daughters that convinced me Jamael had to be a trustworthy person. If you are feeling this letter is way too long, then I suggest you put my shoes on as I’ve been trying to resolve this like a man for over two years.


Continuing on when I was released from the hospital, I jumped in the Jaguar and drove another patient to his home three hours west of Fredericton and relaxed for the week-end. When I returned to Fredericton, I went back to work at CKTP on my daily Talk Show. I was also busy putting final touches on a new radio station, getting permits for five more stations, finding truck loads of stolen restaurant equipment, securing permits to remove gardens from Prospect and Regent Street, working with Cameron’s auctioneers to sell tens of thousands of dollars worth of antiques, etc.


While I was in hospital, I promised the doctor I would take a vacation and get some rest. In fact, he let me leave the hospital one afternoon to book a 5-week trip to Mexico. On April 1st, 2006, I was on a plane alone to spend time doing nothing but relaxing chasing snakes and lizards by myself.


Before leaving to Mexico, I returned the Jaguar to Jamael as he had promised to put on new tires, do the brakes and give it a good detailing. During the two weeks I had it, I had put 3,000 km on it and was satisfied that with these things done while I was away, that when I returned in early May, my dream car would be ready for the summer.


My D.J., Robb Hartland drove with me in the Jaguar to Halifax to see me off and he drove the Jag back and turned it over to Jamael.


When I returned to Fredericton, I got hold of Jamael and told him while I was away I had time to reflect. I had realized that buying the Jaguar was a stupid, rash decision and asked if he could sell it for me. He said he doubted if he could get $18,500 for it and I told him I understood. I told him to see if he could sell it quickly for $13,500 to $15,000 which he assured me he could. He told me to get the insurance taken off it and he would put it back on his fleet insurance as it was much cheaper. When I asked if I owed my taxes on the $18,500 purchase, he said no as he had not changed the registration from the previous owner to me. I also asked if he had gotten the promised work done on the vehicle and he said no, but it was at Andy’s shop (York Motors) getting done.


This was May 6th, 2006. I believe it was around this time that Jamael got a job offer in Dubai selling pharmaceutical products and teaching Saudi princes to drive their high-end cars. At least that’s what he told me.


His shop, Auto Works, was left in the care of a young man whose name eludes me at the moment but he will testify I stopped in on numerous occasions to see if anyone expressed an interest in the Jaguar. There was little interest however a Police officer had taken it for a full weekend to test drive and the young man felt confident he would be making an offer.


By fall of 2006, I was getting concerned as now there was no one at Auto Werks anymore. I went to see Andy at York Motors and he told me my car was out behind a building on Bishop Drive. When I found the Jaguar, the tires were flat and the battery was dead. Andy came over and got it running for me and I took it to my home and stored it in my garage at 136 Camber Drive.


I talked to Andy about what the heck his friend Jamael was up to and he was as confused by Jamael’s actions as I. He was also starting to wish he never heard of Jamael Instrum. Andy agreed to put up a sign in his shop to try and sell the Jaguar for me. 


Going into 2007, I got fed up with Jamael’s actions and went to my lawyer. It was at this meeting I found out one cannot sign a legal document to purchase anything while in a mental institution. My check was therefore null and void.


Of course, Jamael’s lawyer sees this differently and wants to drag this out through years of stalling tactics. Even if we ever make it to court, all I can succeed in doing is to get a judgment against Jamael and I’m quite sure he has all his personal assets secure under your good name.

In the spring of 2007, I asked Andy at York Motors if I could leave the car on his lot with a “For Sale” sign and he agreed. As luck would have it, on my drive to his shop a transport truck ahead of me on the highway blew out a tire and a piece of rubber 5 feet long and 12 inches wide went under my vehicle. The worn out tires on the back that Jamael hadn’t replaced blew out and I went out of control, damaging the Jaguar. My passenger and I were not injured. Since I was within walking distance of York Motors, I went and got Andy to tow the Jaguar in.


When Andy inspected the damages, he had it towed to Island View Auto Body. The owner, Andrew Lockhart does most of Andy’s repairs and knows Jamael well also. Both Andy and I assumed Jamael had the insurance covered on it and Andrew Lockhart went ahead and ordered necessary parts to do repairs.


When Jamael was finally reached by Andy, we were stunned to find out that he hadn’t put the Jaguar on his fleet insurance. For weeks, I called Jamael and my messages were not returned. It had been over a year now since I gave him my $18,500 and the vehicle was still registered to Dr. Smythe. I could not sell it as no one could locate Dr. Smythe. Only Jamael knew who he was.


When the repairs were done on the vehicle, the price tag was $5,200 and Andy paid the bill as I was out of town at the time and wouldn’t be returning until October of 2007. With the car in mint condition, Andy put it back on his lot and had a number of offers for 12 to 14 thousand dollars. Each offer he referred to me and I accepted. However, he was never able to reach Jamael to get the registration to finalize the deals.


You can speak to Andy in regards to this and he will tell you he was greatly embarrassed by all of this. Andy was involved from the very beginning in all my dealings with Jamael and he was at a loss for words as to why he was acting this way towards me.


In early 2008, I decided to go on a thousand-day spiritual journey around the world and left the fate of the Jaguar in Andy and my ex wife’s hands.


It was decided we would take the first ten thousand dollar offer and Andy would take his fifty-two hundred out and give the remaining forty-eight hundred to my ex wife to put in my bank account.


In May, 2008, I received a phone call from my ex wife that Andy had an offer of ten thousand dollars and he needed me to call him. The call was made and Andy informed me he had contacted Jamael to sign over the registration. Jamael, however insisted that the check be made out in his name, not Andy’s as I had instructed.


Instead of Jamael being an honourable man, he took the ten thousand dollars for himself. I haven’t talked to Andy, but I’m hoping he was at least paid off as Jamael still does business with him. A copy of this lengthy story will be sent to Andy and any others mentioned so if you need confirmation on what I’ve stated, you will know the truth. Jamael’s version of the truth differs, I’m sure.

The thing that annoys me the most is that Jamael went to my ex wife’s place of work (the Fredericton Co-op) and told her, “Tell Jim I’m keeping the ten thousand dollars because he went to a lawyer on me.” 

My ex wife was embarrassed and also hurt by this as she knew I needed this money. It wasn’t bad enough that I was only getting $4,800 back out of the $18,500. (A $13,700 loss) Now he was insulting a woman I love. Through all of this I never once threatened him nor involved his loved ones. It was bad enough that a nice guy like Andy had to be dragged into this.


Because of these actions the only satisfactory solution to this will be for the sum of $18,500 to be deposited to my bank account by Dec. 31/08. If it’s not done, then this letter will become part of my blog and I will send the link to every Orthodontist office in Canada to warn people about Susan Instrum’s husband, Jamael. I will be sure to say that from what I know of Susan, she’s a sweet, honest woman, but beware of her husband as he will hide behind her reputation to scam whatever he can from them.


Susan, this is not how I do business, but Jamael has left me little choice. The last straw was embarrassing my ex wife.


Early in the New Year, I will be leaving Canada with the intentions of opening an orphanage in the third world. If you follow my blog, you’ll find that  people are going to be offered an opportunity to make donations to my new life as a man of God. My capitalistic life is behind me now and I plan to spend my life making the world my home and children my cause.


I wish you and your beautiful daughters a very merry Christmas. Let Jamael know as a man of God, I already forgive his actions and wish him only prosperity in his future business ventures.
